In February 2019, following a directive from the President at a Cabinet meeting, the Korean government introduced the “Regulatory Government Burden of Proof System.” Under this system, the government is required to demonstrate to the public why regulations under its jurisdiction remain necessary. Regulations that cannot be justified are subject to improvement or repeal.

To implement this system, the Ministry of Science and ICT (MSIT) established the Existing Regulations Review Committee, chaired by the First Vice Minister. The committee reviews and makes decisions on the continued necessity of regulations under MSIT’s jurisdiction, covering areas including telecommunications, broadcasting, radio communications, ICT quality, and research laboratories. At the time, the review covered 107 administrative rules and approximately 900 regulatory provisions.

Attorney Jae-kwon Jeong of Hwaum Law Office was appointed as the legal-sector representative on the Existing Regulations Review Committee of the Ministry of Science and ICT and served for one year, participating in the review and deliberation of regulations under the Ministry’s jurisdiction.

Through this role, he sought to contribute to maintaining only regulations that are genuinely necessary while promoting the rational improvement of regulations that may be unnecessary or unreasonable.
