In July 2021, Hwaum Law Office successfully represented a U.S.-based company in completing its foreign investment registration in the company’s name.

Foreign investment registration is a system under which a foreign investor must register certain personal and corporate information with the Financial Supervisory Service (FSS) before initially acquiring or disposing of securities listed on the Korea Exchange (KOSPI or KOSDAQ), or securities offered or sold for the purpose of being listed on those markets.

To complete foreign investment registration in the name of a corporate entity, various documents must be prepared and submitted to the FSS, including the foreign investment registration application and the company’s Articles of Incorporation. Certain documents, including the Certificate of Incorporation, must be notarized and authenticated with an Apostille* in the foreign jurisdiction.

It is important to prepare and submit all required documents accurately and completely. Failure to do so may result in the application being rejected or returned for correction, potentially causing delays to the client’s investment plans.

Hwaum Law Office assisted the client in preparing and submitting the foreign investment registration application, reducing the administrative burden associated with document preparation, notarization, and obtaining Apostille certification. Hwaum also provides complimentary English-Korean translation services within the scope of our standard services, helping clients reduce translation-related costs.

Through this streamlined approach, Hwaum Law Office provides foreign clients with convenient and efficient assistance in completing foreign investment registration in Korea.

* An Apostille is a certification issued under the Hague Apostille Convention that authenticates the origin of a public document for use in another member country, eliminating the need for traditional legalization procedures.
